DIGITAL PHOTOGRAPHS
YG Commemorative ® can only accept digital photographs on this website.  By delivering the digital photograph (”Photograph”) to YG Commemorative you warrant and covenant that (i) you own or otherwise possess all necessary rights with respect to the Photograph, (ii) the Photograph you have submitted does not and will not violate any intellectual property or proprietary right of any third party and (iii) you hereby consent to YG Commemorative’s use of the Photograph in connection with the products ordered.

• Digital photographs must in .jpg format and be 4MB or smaller in size
• You are advised to take a straight on, eye-leveled headshot picture from the front using any normal digital camera with a megapixel rating of 3 MP (megapixels) or higher.  For best results, YG Commemorative ® recommends taking the headshot picture 2 – 4 feet away from the Graduate with a solid colored background without using any zoom-in functions found on a digital camera.

COLOR ACCURACY OF DIGITAL PHOTOGRAPHS
While YG Commemorative ® makes every effort to reproduce every Photograph as accurately as possible, you acknowledge that due to variations in printing, different camera software, different monitor resolution and/or monitor settings, and other factors, the final product may not exactly match the preview image found on this website.

SPELLING OF CUSTOMIZED TEXT / SIZE OF TEXT / ALIGNMENT OF TEXT / COLOR OF TEXT
The customized text spelling found inside the banner portion, the customized spelling of the Graduate’s name, and the size, alignment and color of the customized text are your sole responsibility.  You will be able to preview their Product with all customized inputted text, spellings, size, alignment and font color customizations before saving the file and making payment for their YG Commemorative ® Product.

PAYMENTS & REFUNDS
Due to the custom nature of YG Commemorative’s ® Products, all orders are non-refundable.  The full amount of the purchase price is due when orders are placed.  All information that you provide to YG Commemorative or our third party payment processor must be accurate, current and complete.  YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT MEANS USED TO PURCHASE THE PRODUCTS.  Verification of information applicable to a purchase may be required prior to our acceptance of any order.

YG COMMEMORATIVE ® CURRENT ORDER YEAR
YG Commemorative ® follows a traditional middle school, high school, and college school year; a given school year begins in the month of August with graduation in the following year’s May and/or June months.

For all custom made YG Commemorative ® products, the “current order year” is defined as orders taken from the beginning of the pre-order period (August 1) with delivery of custom made products in the following year.

PRE-ORDERED PRODUCTS – DELIVERY DATE OF PRODUCT / DELIVERY ADDRESS / METHOD OF DELIVERY
YG Commemorative ® starts accepting pre-orders on August 1 of each year with in-home delivery before graduation (Assumes following year, May or June graduation date).  YG Commemorative’s primary pre-order intake dates span from August 1 – October 31 in the beginning of a current order year.  Provided there are still quantities available, YG Commemorative ® will continue to take pre-orders up until April 1 of a current order year. 

YG Commemorative ® currently ONLY ships to physical addresses throughout the 48 continental U.S., Alaska, and Hawaii.  

YG Commemorative ® currently DOES NOT ship to P.O. Box addresses, U.S. territories, or internationally. 

All orders will be shipped out, using ground delivery service only, between mid March and late April of the current order year on a first come first served basis.  Mountain and medallion products will ship separately and will arrive separately. 

Orders will be delivered to the delivery address given when placing your order.  Delivery addresses cannot be changed or modified after your order is placed.  Because each school’s graduation commencement date is different, YG Commemorative ® cannot guarantee that your order will arrive prior to the Graduate’s graduation commencement date.

PRODUCTS ORDERED AFTER APRIL 1 – DELIVERY DATE OF PRODUCT / DELIVERY ADDRESS / METHOD OF DELIVERY
Provided quantities for personalized products are still available for sale after April 1 of the current order year, YG Commemorative ® will expedite the assembly of your personalized graduation keepsake product within 14 days.

YG Commemorative ® currently ONLY ships to physical addresses throughout the 48 continental U.S., Alaska, and Hawaii.

YG Commemorative ® currently DOES NOT ship to P.O. Box addresses, U.S. territories, or internationally.

Upon expedited assembly of your personalized graduation keepsake product, all orders will be shipped using ground delivery service.  Mountain and medallion products will ship separately and will arrive separately. 

Orders will be delivered to the delivery address given when placing your order.  Delivery addresses cannot be changed or modified after your order is placed.  Because each school’s graduation commencement date is different, YG Commemorative ® cannot guarantee that your order will arrive prior to the Graduate’s graduation commencement date.

LIMITED WARRANTY
YG Commemorative ® warrants the YG Commemorative ® Glass Mountain keepsake and YG Commemorative ® personalized medallion keepsake against defects in material and workmanship for a period of 14 days from the date of delivery (”Warranty Period”). YG Commemorative ®, at its option, will repair or replace this product or any component of the product found to be defective with a new or remanufactured product or component provided that you obtain return authorization prior to the expiration of the Warranty Period and return the product to YG Commemorative, postage prepaid and through “acceptable shippers” within 5 business days of receipt of such authorization.  This warranty does not cover damage due to acts of nature, accident, misuse, abuse, negligence, improper maintenance, or use in violation of instructions furnished by YG Commemorative ®.  In addition, please note, for the YG Commemorative ® Glass Mountain keepsake, each Glass Mountain keepsake is custom made to order and will vary due to the uniqueness of each piece.  Small bubbles found between the base and glass mountain body are not considered defects and are normal.

INDEMNIFICATION
You agree to indemnify, defend and hold YG Commemorative and its officers, managers, members, employees, agents and suppliers harmless against all claims liabilities, losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from (i) any violation of these Terms and Conditions and (ii) any claim that a Photograph infringes a third party’s intellectual property rights.

PRIVACY POLICY
YG Commemorative ® respects your privacy.  When an order is placed, you provide information including: your name, Graduate’s name, contact telephone number, contact email address, mailing address, and Graduate’s picture.  YG Commemorative ® will not sell, barter, lease, rent, donate, share, or make public your information.  YG Commemorative ® will only use information provided to fulfill your order.  In order to allow us to fulfill your order, we will disclose some or all of the information you have provided to among others, credit card authorization companies, our suppliers and shippers.  In addition, YG Commemorative ® may disclose your personal information in the following situations as we believe to be appropriate:  (a) under applicable law; (b) to comply with legal process; (c) to respond to governmental requests, including requests from law enforcement and regulatory authorities; (d) to enforce our Terms and Conditions (e) to permit us to pursue available remedies or limit the damages that we may sustain.    YG Commemorative seeks to have reasonable security measures in place to help protect against loss, misuse and alteration of the information under our control.  Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure.  As a result, although we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit to us or that is stored by us.  You acknowledge and agree than any information you transmit to us is transmitted at your own risk.    We reserve the right to modify our Privacy Policy at any time.   Any changes to our Privacy Policy will become effective upon our posting of the revised Privacy Policy. 

APPLICABLE LAW
The laws of the State of Illinois shall apply to this transaction.  You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Cook County, Illinois, U.S.A. in all disputes arising out of or relating to the use of this Site and the purchase of any YG Commemorative ® Products or any matters set forth in these Terms and Conditions.
